Human smuggling in Hungary

Human smuggling is committed by anyone who helps another person cross the state border unlawfully. Even the basic case carries 1–5 years’ imprisonment, and the courts typically sentence strictly. Proceedings are often brought against people who only did the driving and did not understand what they had become involved in.

Typical situations

  • a driver who took a “ride” from an online advert and is found with undocumented passengers at a check;
  • a lorry driver with people hiding in the cargo area;
  • organising accommodation, routes or border crossings for others;
  • payment per person or per trip.

What is the penalty?

CasePenalty
Basic case1–5 years
For financial gain, helping several people, or damaging the border fence2–8 years
With ill-treatment of the smuggled person, armed, carrying a weapon, on a commercial basis or in a criminal conspiracy5–10 years
These combined with further aggravating circumstances5–15 years
Organiser or leader of the aggravated cases10–20 years
Preparationup to 3 years

“Several people” and “financial gain” come up in almost every case in practice, so most cases fall at least within the 2–8 year range.

What does the defence look at?

  • Did they know? Human smuggling can only be committed intentionally. The defence examines what the driver could have known about the passengers, the route and the assignment.
  • Role: the liability of a driver and an organiser are sharply different; the defence aims to ensure that the accused is held liable according to their actual role, not as part of the network.
  • Commercial basis, criminal conspiracy: proof of these often rests only on phone data, the interpretation of which can be challenged.
  • Interpreter and consul: a foreign defendant is entitled from the very first minute to an interpreter in their own language and to have their consulate informed.

Frequently asked questions

I was arrested at the border – what can I expect? In human smuggling cases detention and a motion for pre-trial detention are common. At the detention hearing the defence lawyer can ask for a milder measure (for example criminal supervision).

I only accepted a ride, for money. If you knew that the passengers were crossing the border unlawfully, this may be aggravated human smuggling. Do not make a statement without a lawyer.
