Dear Future Client, Dear Interested Party!

A criminal proceeding is the most severe form of legal process that a citizen can face. Anyone involved in a criminal proceeding, whether as a perpetrator, victim, or witness, needs assistance. Never confront the state’s criminal power without legal help. Although your rights are protected by numerous legal guarantees, the enforcement of these rights is not automatic.

In the fight for innocence and freedom, the state holds a significant power advantage, and the investigative authorities have a clear advantage in experience. Furthermore, it is regrettable that neither the investigative authorities nor the prosecution shy away from the abusive use of legal or extralegal means when necessary. A significant proportion of criminal proceedings are based on preconceived notions, which—despite the burden of proof resting on the investigative and prosecutorial side—are very difficult to refute or overturn.

A small mistake, a poorly chosen word, an inadequately emphasized sentence, or an incorrect statement can seal the outcome of the entire case and, with it, your fate. Since it often happens that an arrest, the first questioning of a suspect, or the continuation of a witness questioning as a suspect questioning may occur without the presence of a lawyer, we recommend the following in your own interest until we can take over your defense.

You must attend at the address and time stated in the summons. If you are worried that you may be asked sensitive questions, consult a defence lawyer beforehand. If necessary, attend the interview with a criminal defence lawyer. If a question arises during the interview that, if answered, would incriminate you or a relative, refuse to testify.

Contact a defence lawyer as soon as you receive the summons.

  • File a complaint against the suspicion
  • Refuse to testify
  • Refuse to answer every question
  • Ask for a copy of the record (you are entitled to it free of charge)
  • Contact a defence lawyer immediately

File a complaint against being taken into custody, and name a relative whom the authorities may notify of your detention.

Study the investigation documents you are given carefully, keep them, and do not make a statement on the merits of the case. Give an address where you can be summoned; ask primarily to be released, or alternatively for a less restrictive measure (criminal supervision). If pre-trial detention is ordered, appeal against the decision. Contact a relative so that, through them, you can ask a defence lawyer to help secure your release as soon as possible.

Try to find out which authority is handling the case (which police station or prosecutor’s office) and where your relative is being held (police cell or which prison). Contact a defence lawyer immediately.

Do not help the search succeed by handing over any evidence that may incriminate you before it is found – the search will be carried out regardless. Check the search record and the list of seized or found items and evidence carefully. Keep the documents you are given and contact a defence lawyer.

Contact a criminal lawyer who can draft the criminal complaint, represent your rights and interests in the proceedings, and make sure that you can enforce your financial claim against the offender as a civil claim.

  • File a complaint against the suspicion
  • Refuse to testify
  • Ask for a free copy of the record
  • Contact a defence lawyer without delay

  • Consult a defence lawyer
  • Find out about your options and rights
  • Work out your possible defence in advance with your criminal defence lawyer
